The Australian High Court overturned the legalization of gay marriage

High Court of Australia ruled that the law on the legalization of same-sex marriages, passed the Australian Capital Territory (ACT), is contrary to federal law and, consequently, is not valid. A statement published on the website Instance on 12 December.





As explained in the document adopted in Canberra law is contrary to the federal law "On Marriage» («Marriage Act») 1961, defines marriage as a union between a man and a woman. Although the constitution does not prohibit same-sex unions, the federal law is a "full and complete account of the marriage law," the document says.

According to the Court, the decision to legalize same-sex marriage is the responsibility of Parliament. The Australian Parliament is considering a relevant bill in 2012, and has not accepted it.

The law allowing gay marriage, was passed in the Legislative Assembly of the Australian Capital Territory, October 22, 2013.
