Dutch court overturned blocking The Pirate Bay
Yesterday was published decision of the Dutch court at the suit of "anti-piracy" organization BREIN against two ISPs Ziggo and XS4ALL. The process began in 2010 with the requirements of BREIN to restrict access to The Pirate Bay in the Netherlands under the pretext of violation of copyright tracker. The Court of First instrantsii took their arguments and ordered the ISPs to block access to all users. The decision caused a great resonance, as a benchmark for the European Union.
In the second instance court sided with the defendants and agreed to the inadmissibility of blocking sites as ineffective measures that infringe the rights to freedom of providers of business. In addition to the resumption of the court also sentenced access BREIN to pay considerable compensation providers: 189,891, 13 euros for the first instance and 136,030 euros for the second. In BREIN is still a possibility to apply to the Supreme Court, but it is not known whether they will take advantage of it.
By the way it is likely that the decision affected - among other reasons - and the introduction of locks in Russia last year. Nationwide efforts of the story get loud enough and the new Russian "Internet censorship" is not found just lazy. And even more so she could not get past the judges who have to decide on a similar case. It is unlikely that someone recognizes openly, but incentive "not to assimilate" could play a role.
This is the question: why flutter if the authorities we still ignore. Never know where and how to reverberate our words and actions. Petition, round tables, public action - all this is undoubtedly necessary, as it is necessary to use every opportunity to convey their views to government officials. Sometimes a drop of something really sharpens.
